{"id":16747,"date":"2023-09-19T15:07:11","date_gmt":"2023-09-19T19:07:11","guid":{"rendered":"https:\/\/www.teanecktoday.com\/blog\/?p=16747"},"modified":"2023-09-19T15:07:11","modified_gmt":"2023-09-19T19:07:11","slug":"teaneck-cannabis-survey-why-havent-results-been-released","status":"publish","type":"post","link":"https:\/\/www.teanecktoday.com\/blog\/teaneck\/teaneck-cannabis-survey-why-havent-results-been-released\/","title":{"rendered":"Teaneck Cannabis Survey: Why Haven&#8217;t Results Been Released?"},"content":{"rendered":"<p>Until today, <a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2023\/09\/Township-of-Teaneck-Cannabis-Survey-Jan.-2023-Results11_Redacted_Redacted.pdf\">results from the survey<\/a> conducted by the Cannabis Subcommittee have never been published.<\/p>\n<ul>\n<li><strong>Who created the Cannabis Survey and sent it out to residents?<\/strong><\/li>\n<li><strong>Who created the Cannabis Forum at the Rodda Center?<\/strong><\/li>\n<li><strong>Who directed employees to attend\/work at the event?<\/strong><\/li>\n<\/ul>\n<p>The answers matter because the Council may only act as a body, not as individuals or even a subcommittee (a group of 1-3 members of the council formed to discuss issues)<\/p>\n<blockquote><p>&#8220;<strong>It is the intention of this article that the municipal council shall act in all the matters as a body<\/strong>, and<span style=\"text-decoration: underline;\"> it is contrary to the spirit of this article for any of its members to seek individually to influence the official acts of the municipal manager<\/span>&#8230; The <span style=\"text-decoration: underline;\"><strong>council and its members shall deal with the administrative service solely through the manager<\/strong><\/span> and <span style=\"text-decoration: underline;\"><strong>shall not give orders to any subordinates of the manager, either publicly or privately<\/strong><\/span>.&#8221;<br \/>\nsource: <a href=\"https:\/\/casetext.com\/statute\/new-jersey-statutes\/title-40-municipalities-and-counties\/chapter-4069a-election-on-question-whether-charter-commission-shall-be-elected\/section-4069a-91-municipal-council-to-act-as-a-body-administrative-service-to-be-performed-through-manager-committees-or-commissions\">NJ Rev Stat \u00a7 40:69A-91<\/a><\/p><\/blockquote>\n<h3>Sebastian Castillo<\/h3>\n<p>On April 5, 2022, Mr. Sebastian Castillo <a href=\"http:\/\/teanecktownnj.iqm2.com\/Citizens\/SplitView.aspx?Mode=Video&amp;MeetingID=1820&amp;Format=Minutes\">appeared before Council<\/a> to give a <a href=\"http:\/\/teanecktownnj.iqm2.com\/Citizens\/SplitView.aspx?Mode=Video&amp;MeetingID=1820&amp;Format=Minutes\">presentation<\/a> as to why the Township should grant him a letter authorizing him to apply for a license to open a Cannabis Dispensary in Teaneck. [<a href=\"http:\/\/teanecktownnj.iqm2.com\/Citizens\/SplitView.aspx?Mode=Video&amp;MeetingID=1820&amp;Format=Minutes\">video<\/a>]\n<p>In <a href=\"http:\/\/teanecktownnj.iqm2.com\/Citizens\/Detail_LegiFile.aspx?ID=7198\">Resolution 106-2022<\/a>, the Council granted Mr. Castillo local support for the granting of a license to his company, Galaxy Express NJ, LLC.<\/p>\n<p>Mr. Castillo continued coming to council meetings through December, requesting zoning expansion (beyond Alfred Avenue) for Cannabis dispensaries.<\/p>\n<p>Then, after the new Council was seated in January, Mr. Castillo wrote to the Cannabis Subcommittee indicating that he created a google form, which they could use to determine whether the residents were willing to see an expansion of Cannabis zoning for retail stores.<\/p>\n<p>Through an Open Public Records Act (OPRA) request, you can see he email below.\u00a0 The link for the form is still active and is available on archive.org.<\/p>\n<p><a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2023\/09\/2023-01-11_Email-from-Sebastian-Castillo-with-survey.jpg\" \/><\/a><\/p>\n<h2>The Survey and the Forum<\/h2>\n<p>As you may be aware, the council sent out this survey earlier this year, seeking resident comments regarding cannabis zoning in Teaneck.<br \/>\n(Note: The <a href=\"https:\/\/www.teanecknj.gov\/news\/post\/16503\/\">original municipal page<\/a> with the survey has been <strong>deleted<\/strong> from the Township website, but is available <a href=\"https:\/\/web.archive.org\/web\/20230119034327\/https:\/\/www.teanecknj.gov\/news\/post\/16503\/\">here<\/a> via archive.org)<br \/>\nThe <a href=\"https:\/\/docs.google.com\/forms\/d\/e\/1FAIpQLSesTPG9-XvIzvdPq9rD-LYBGTW2GLuMWj9SA_SjaVWvyzLzDQ\/closedform\">survey link<\/a> indicates it is no longer open or available:<\/p>\n<blockquote><p>&#8220;The form Township of Teaneck | Cannabis Zoning Survey | January 2023 is no longer accepting responses.&#8221;<\/p><\/blockquote>\n<p>That survey had raised many questions (see our former <a href=\"https:\/\/www.teanecktoday.com\/blog\/teaneck\/fmr-mayor-jim-dunleavy-dear-teaneck-council\/\">Mayor Dunleavy&#8217;s post here<\/a>), and Open Public Records Act (OPRA) requests seeking to find the derivation of the survey have thus far gone unanswered (the post will be updated if any additional responses are received).<\/p>\n<p><strong>Deputy Mayor Danielle cache -->\n<h2>So what happened to the survey?<\/h2>\n<p>Residents questioned the validity of the survey and forum held by the township.\u00a0 Some sought information about cannabis zoning\/council actions on Facebook.\u00a0 In response, the husband of Deputy Mayor Danielle Gee indicated:<\/p>\n<blockquote><p>&#8220;Just to be clear, only Mayor Pagan, CW Goldberg, and CW Belcher along with the Manager etc were involved in planning this forum.&#8221;<br \/>\n(<a residents<\/li>\n<li>Directed the town attorney to draft ordinances<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>SIX MONTHS LATER: Where are the survey results?<\/p>\n<p>Teaneck Today submitted an OPRA request and received the survey results (which included some data on the individuals filling out the survey).\u00a0 Using emails and IP address info, along with a review of responses, it appears that several people submitted the survey results multiple times, making any assertions from the survey&#8217;s results, problematic.<\/p>\n<p>Council <a
