Jones"},"content":{"rendered":"<p>Two weeks ago, an order was entered in Superior Court for Bergen County in the case entitled: In the Matter of Elie C. Jones. Jones has been in the Teaneck news cycle over the past two years as he <a href=\"https:\/\/www.northjersey.com\/story\/news\/bergen\/teaneck\/2017\/01\/17\/four-teaneck-employees-subject-residents-criminal-complaints\/96678634\/\">filed<\/a> hundreds of public records requests to Teaneck, <a href=\"https:\/\/www.northjersey.com\/story\/news\/bergen\/teaneck\/2017\/02\/23\/judge-dismisses-residents-criminal-complaints-against-teaneck-employees\/98267980\/\">entered<\/a>\u00a0multiple civil rights complaints against the Teaneck police,\u00a0<a href=\"https:\/\/www.northjersey.com\/story\/news\/bergen\/teaneck\/2017\/03\/22\/teaneck-names-firm-defend-clerk-against-resident\/99412148\/\">accused<\/a> the township clerk of assault, and was eventually <a href=\"https:\/\/www.northjersey.com\/story\/news\/bergen\/teaneck\/2017\/03\/01\/judge-hears-teaneck-lawsuit-against-resident\/98584608\/\">sued<\/a> by Teaneck to stop the flood of public records requests.<\/p>\n<p style=\"text-align: center;\"><strong>Join the discussion at Teaneck Today&#8217;s <a href=\"https:\/\/www.facebook.com\/groups\/1074723772580877\">Facebook Group<\/a><\/strong><\/p>\n<p>The Township has maintained that Jones has been abusive and his complaints are without merit.<\/p>\n<p>The Court now concludes:<\/p>\n<blockquote><p>Suffice it to say, Jones&#8217; actions patently demonstrate a willful desire to abuse the\u00a0judicial process and absorb precious state and judicial resources. His use of the judicial\u00a0system is intended to spite others, and to punish anyone, including court staff who do not\u00a0act as he directs: This is not the intended purpose of the judiciary and <strong>his actions are\u00a0intolerable<\/strong>. (emphasis added) (page 29)<\/p><\/blockquote>\n<p><!--more--><\/p>\n<p>The <a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/07\/BER-L-002683-18_Order-2018-06-29.pdf\">order<\/a>, shown below is about 40 pages with another 50 pages of exhibits.<\/p>\n<p>Here are the highlights:<\/p>\n<ul>\n<li>Any civilian complaints filed by Jones since 1\/1\/18 are dismissed (unless a probable cause determination has already been made)<\/li>\n<li>Jones is prohibited from filing\u00a0any &#8220;criminal, quasi-criminal, civil\u00a0or municipal code violation complaint&#8221; in any court in the State of New Jersey without prior approval of a Judge.<\/li>\n<li>Clerks in the Superior and Municipal Courts are directed to refuse any complaint for filing from Jones unless and until he gets approval from a Judge.<\/li>\n<li>Jones is banned from even entering a Courthouse unless he has a hearing scheduled.<!--more--><\/li>\n<li>Jones&#8217; request for the Judge in his case to recuse herself is denied<\/li>\n<li>Jones&#8217; request for the Trial Court Administrator to be removed as his liaison is denied.<\/li>\n<\/ul>\n<hr \/>\n<a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/07\/BER-L-002683-18_Order-2018-06-29.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-toolbar=\"bottom\" data-toolbar-fixed=\"off\">BER-L-002683-18_Order 2018-06-29<\/a>\n<hr \/>\n<p>As mentioned in the order, Jones is a &#8220;<em>self-represented<\/em> litigant&#8221; who files a lot of cases.\u00a0\u00a0Jones has filed suit against &#8220;various Township of Teaneck employees, police officers, councilmembers and\u00a0residents. Jones has also filed civilian criminal complaints against employees of the New\u00a0Jersey Judiciary including: Hon. Bonnie J. Mizdol, A.J.S.C., Hon. Robert P. Contillo,\u00a0P.J.Ch.; Hon. Peter J. Melchionne, P.J.F.P.; and Trial Court Administrator Laura\u00a0Simoldoni (&#8220;TCA Simoldoni&#8221;), all of the Bergen Vicinage.&#8221; (page 3)<\/p>\n<p>As an illustrative example, on 3\/5\/18, &#8220;Teaneck Police Officer Harold Clark issued Jones a parking\u00a0ticket for parking in a &#8220;council members only&#8221; parking space. Illustrative of Jones&#8217;\u00a0pattern of retaliatory filings, between March 14, 2018, and March 15, 2018, he filed 13\u00a0civilian criminal complaints against Police Officer Clark alleging 26 statutory violations.&#8221;\u00a0 Of the 13, the 7 that had probable cause hearings resulted in 6 dismissals and one that is ongoing.<\/p>\n<p>Jones&#8217; conduct has led to massive delays in municipal work, based in large part on the considerable amount of resources necessary to defend against his actions.<\/p>\n<blockquote><p>Teaneck is a body politic of the State of New Jersey, accountable to township\u00a0taxpayers. Each and every time Jones files a complaint against a township employee or\u00a0official, the township council appoints legal counsel to defend the employee against\u00a0Jones&#8217; excessive and unfounded complaints. <span style=\"text-decoration: underline;\">These complaints have a deleterious effect\u00a0on the judicial system and the public interest by absorbing a considerable amount of\u00a0judicial and municipal resources<\/span>. The escalating nature of the complaints threaten the\u00a0economic well-being of the Township, the efficiency of the Teaneck Municipal Court and\u00a0its conflict court, Bergen&#8217;s Vicinage II Municipal Court and further serves to disrupt\u00a0operations of all.\u00a0 (emphasis added)(page 12)<\/p><\/blockquote>\n<p>The cases stem from domestic violence actions initiated by Jones against his sister, Alston.\u00a0 Here&#8217;s what the Judge hearing those actions had to say back in March:<\/p>\n<blockquote><p>In discussing Jones and Alston&#8217;s use of the judicial system Hon. Peter J.\u00a0Melchionne, P.J.F.P., stated:<br \/>\nCredibility of both parties, you say whatever comes to your\u00a0mind. Neither supports statements or allegations with\u00a0evidence they can rely upon. I have little confidence in\u00a0either of your truthfulness or veracity for the truth. The\u00a0parties engage in extreme gamesmanship with the judiciary\u00a0system, and their calling for witnesses without due regard\u00a0for the people. They wish to inconvenience all for their\u00a0own self-gain and not to assist this court in rendering a\u00a0decision. <strong>They each use the judicial system, not for its\u00a0intended purpose<\/strong>. (emphasis added in original) (page 10)<\/p><\/blockquote>\n<p>Here&#8217;s how the Judge opined on the behavior of Jones:<\/p>\n<blockquote><p>It is clear that the way&#8230; [Jones and Alston] conduct\u00a0[themselves] to each other is less than model. You conduct\u00a0yourselves similarly to anyone you encounter, particularly\u00a0here at the courthouse. The minute a staff member may not\u00a0provide you what you asked for, or looks at you funny, or\u00a0asks you to wait, your conduct becomes less than\u00a0appropriate. Similarly, that&#8217;s how you treat each other.\u00a0<strong>The behavior you exhibit in the courtroom in front of me\u00a0and at me and at the Sheriff&#8217;s officers here is deplorable<\/strong>.\u00a0When I enter an unfavorable ruling, I become the target of\u00a0being biased, racist, I&#8217;m accused of pre-judging the case. (emphasis added)(page 10)<\/p><\/blockquote>\n<p>Jones was appointed an attorney to act as his liaison, after an incident that &#8220;involved\u00a0Jones pounding his fist against the Chancery Division\u00a0customer service glass window and his use of profanity. (Simoldoni letter, March 2,\u00a02018).\u00a0 The liaison&#8217;s\u00a0&#8220;expanded role was\u00a0necessitated by continued rude behavior, which included screaming, use of profanity to\u00a0staff as well as the filing of criminal complaints against staff. Complaints by Jones\u00a0against TCA Simoldoni and Family Division Team Leader, Tracy Andolini sent to the\u00a0AOC have been investigated and found to lack merit.&#8221; (page 13)<\/p>\n<p>Jones was relentless in filing complaints and disrupting the functions of the Townships and Courts he encountered.\u00a0 Here&#8217;s how the Court put his actions:<\/p>\n<blockquote><p>The moment Jones comes into contact with\u00a0a civil servant who does not do what he wants the minute he wants it, a tirade ensues and\u00a0all are declared biased, racist, and prejudicial. The same is true of the judiciary. His\u00a0obstructionist techniques cause justice to be delayed for countless others who have\u00a0legitimate controversies to bring before the court. By way of example, on June 28, 2018,\u00a0Jones, while before Hon. Anthony N. Gallina, P.J.M.C., threatened more filings against\u00a0Teaneck&#8217;s Health Officer Ken Katter stating:<\/p><\/blockquote>\n<blockquote>\n<blockquote>[Katter] had an obligation to enforce the health codes and\u00a0he did not. There&#8217;s continuing things going on today. We&#8217;ll\u00a0probably be right back here in a month or so; I&#8217;m going to\u00a0file new complaints and there will be additional\u00a0 evidence\u00a0forthcoming and proofs. And additional paperwork. You\u00a0want paperwork? I&#8217;ll bring it, and lots of it. So, I&#8217;m here\u00a0today to advise Ken Katter, you failed to do your job and\u00a0you continue to fail to do your job. And as you continue to\u00a0fail to do your job these charges will be continued. (page 29)<\/p><\/blockquote>\n<\/blockquote>\n<p>Will this be the end of Jones harassing Teaneck officials, residents, courts and others?<\/p>\n<blockquote><p>Jones also stated &#8220;[i]f I cannot seek judicial action in way of criminal complaints as the\u00a0procedure [sic] <strong>I will have to resort to alternative means of justice and resolving crimes\u00a0committed by the defendants by any means necessary as brother Malcom [sic] X once\u00a0truly stated<\/strong>. Peace be unto him.&#8221; (emphasis added) (page 31)<\/p><\/blockquote>\n<p>That remains to be seen.<\/p>\n<hr \/>\n<p>Here are the stats on Jones&#8217; filings, as of June 26, 2018:<\/p>\n<ul>\n<li>668 Open Public Records Act (OPRA) Requests between 1\/1\/15 and 6\/27\/18.<\/li>\n<li>\n<ul>\n<li>78 Municipal Court OPRA requests (65 in Teaneck)<\/li>\n<\/ul>\n<\/li>\n<li>214 civilian criminal complaints since 2016<\/li>\n<li>\n<ul>\n<li>201 were filed in 2018 (115 since the issuance of the Order to Show Cause on 4\/6\/18, which this decision was based on)<\/li>\n<\/ul>\n<\/li>\n<li>66 Cases have been adjudicated.<\/li>\n<li>\n<ul>\n<li>54 have been dismissed (either lack of probable cause or voluntarily by Jones)<\/li>\n<li>12 were found to have the requisite probably cause<\/li>\n<li>\n<ul>\n<li>2 of these were dismissed voluntarily by Jones<\/li>\n<li>8 await trial<\/li>\n<li>1 resulted in a not guilty<\/li>\n<li>1 resulted in a guilty finding<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<p>Thank you to <a href=\"https:\/\/www.raffandraff.com\/attorneys\/daniel-a-levy\/\">Dan Levy<\/a>, Esq. of Raff &amp; Raff, LLP for his help obtaining records.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Two weeks ago, an order was entered in Superior Court for Bergen County in the case entitled: In the Matter of Elie C.
