{"id":333,"date":"2018-07-24T22:04:46","date_gmt":"2018-07-24T22:04:46","guid":{"rendered":"https:\/\/www.teanecktoday.com\/blog\/?p=333"},"modified":"2018-07-24T22:04:46","modified_gmt":"2018-07-24T22:04:46","slug":"nj-ag-seeks-temporary-halt-to-municipal-marijuana-prosecutions","status":"publish","type":"post","link":"https:\/\/www.teanecktoday.com\/blog\/uncategorized\/nj-ag-seeks-temporary-halt-to-municipal-marijuana-prosecutions\/","title":{"rendered":"NJ AG Seeks Temporary Halt To Municipal Marijuana Prosecutions"},"content":{"rendered":"<p>Last week, a showdown between Jersey City Mayor \/ prosecutors and the State Attorney General over municipal authority to stop marijuana related prosecutions has taken a new turn.<\/p>\n<p>In a <a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/07\/AG-Grewal-to-Prosecutors-Municipal-Decriminalization.pdf\">letter<\/a> to all County and Municipal prosecutors, the State Attorney General stated:<!--more--><\/p>\n<blockquote><p>I plan to\u00a0convene a working group of criminal justice stakeholders \u2013 including the Hudson County Prosecutor and\u00a0the Chief Municipal Prosecutor of the City of Jersey City \u2013 to study the issue and advise me on possible\u00a0solutions. By the end of August, I intend to issue a statewide directive concerning the scope and\u00a0appropriate use of prosecutorial discretion in marijuana-related offenses in municipal court.<\/p>\n<p>In the interim, I ask that all municipal prosecutors in New Jersey seek an adjournment until\u00a0September 4, 2018, or later, of any matter involving a marijuana-related offense pending in municipal\u00a0court.<\/p><\/blockquote>\n<p>In the accompanying <a href=\"https:\/\/nj.gov\/oag\/newsreleases18\/pr20180724a.html\">press release<\/a>, &#8220;the Attorney General made clear that Jersey City\u2019s decriminalization memorandum was an improper exercise of a municipal prosecutor\u2019s authority and reiterated that it was void.&#8221;\u00a0 However, &#8220;[a]t the conclusion of yesterday\u2019s meeting, the Attorney General stated that he wanted to work with criminal justice stakeholders \u2013 including County Prosecutor Suarez and the Jersey City Chief Municipal Prosecutor \u2013 to clarify the scope and appropriate use of prosecutorial discretion in marijuana-related offenses in municipal court.&#8221;<\/p>\n<p>The working group will meet and make policy recommendations.<\/p>\n<p>The full letter appears here:<\/p>\n<a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/07\/AG-Grewal-to-Prosecutors-Municipal-Decriminalization.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-toolbar=\"bottom\" data-toolbar-fixed=\"off\">AG-Grewal-to-Prosecutors--Municipal-Decriminalization<\/a>\n","protected":false},"excerpt":{"rendered":"<p>Last week, a showdown between Jersey City Mayor \/ prosecutors and the State Attorney General over municipal authority to stop marijuana related prosecutions has taken a new turn.
