{"id":5628,"date":"2021-04-25T03:01:08","date_gmt":"2021-04-25T08:01:08","guid":{"rendered":"https:\/\/www.teanecktoday.com\/blog\/?p=5628"},"modified":"2021-04-25T09:59:03","modified_gmt":"2021-04-25T14:59:03","slug":"why-the-cluck-cant-i-own-a-chicken","status":"publish","type":"post","link":"https:\/\/www.teanecktoday.com\/blog\/health\/why-the-cluck-cant-i-own-a-chicken\/","title":{"rendered":"Why the cluck can&#8217;t I own a chicken?"},"content":{"rendered":"<p>People like raising chickens.\u00a0 They give delicious eggs and people that raise them say that it&#8217;s a clean sustainable pet\/food source that should be available in Teaneck.<\/p>\n<p>There&#8217;s also a local <a href=\"https:\/\/ecode360.com\/13475527?fbclid=IwAR3GHlgM9kk8YS-HuxaVS4pxLilOhc0SJhGhU7JRoWmi4mBfZhZ06LZGkSE#13475527\">ordinance<\/a> prohibiting it:<\/p>\n<p><a href=\"https:\/\/ecode360.com\/13475527\" target=\"_self\" rel=\"noopener\">Sec.\u00a06-5: Keeping of pigs, horses and certain other animals prohibited.<\/a><\/p>\n<div class=\"history\">[R.O. 1951, ch. 6, \u00a7\u00a04;\u00a0<span class=\"legref\" data-ref=\"\"><span class=\"loclaw\">Ord. No. 3411<\/span>,\u00a0<span class=\"hisdate\">12-20-1994<\/span><\/span>, \u00a7\u00a01.]<\/div>\n<blockquote>\n<div class=\"para\">No person shall keep or allow to be kept in any building or premises, or on any lot of ground of which he may be the owner, tenant, lessee or occupier, any pigs, horses, mules, cows, pigeons or poultry of any age or description.<\/div>\n<\/blockquote>\n<div>Repeal movements have come and gone since the rule was created in 1927.\u00a0 There&#8217;s one happening now.<\/div>\n<p>It even has a Facebook Group:<strong> <a href=\"https:\/\/www.facebook.com\/groups\/teaneckchickens\/permalink\/489847882208467\">Keep Chickens Teaneck<\/a><\/strong><\/p>\n<h3>So what&#8217;s the deal with chickens and this ban?<\/h3>\n<div class=\"kvgmc6g5 cxmmr5t8 oygrvhab hcukyx3x c1et5uql\">\n<div dir=\"auto\">The practice of owning chickens in town was regulated in the \u201920s as population density turned Teaneck from farmland to residential<sup>1<\/sup>. It was formally banned anywhere a decade later in 1937.<\/div>\n<\/div>\n<div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql\">\n<div dir=\"auto\">(census estimates show the population changing from <a href=\"https:\/\/archive.teanecklibrary.org\/TeaneckPlan\/TheTeaneckPlan1933.pdf#page=6\"><strong>4,192<\/strong> in 1920<\/a> to <a href=\"https:\/\/www.state.nj.us\/labor\/lpa\/census\/2kpub\/njsdcp3.pdf#page=28\"><strong>16,513<\/strong> in 1930<\/a> and then to <a href=\"https:\/\/www.state.nj.us\/labor\/lpa\/census\/2kpub\/njsdcp3.pdf#page=28\"><strong>25,275<\/strong> in 1940<\/a>)<\/div>\n<div dir=\"auto\"><\/div>\n<\/div>\n<div dir=\"auto\">This ordinance is one of the oldest the municipality has.<\/div>\n<div dir=\"auto\">Ordinance 412 appeared in July 1927<\/div>\n<p><!--more--><\/p>\n<div dir=\"auto\"><a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2021\/04\/1927-07-08_Ord-412-Title.png\" data-rel=\"lightbox-image-0\" data-rl_title=\"\" data-rl_caption=\"\" title=\"\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-5646\" src=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2021\/04\/1927-07-08_Ord-412-Title.png\" alt=\"\" dir=\"auto\">At the time, keeping chicken coops 25 feet from dwellings or apartments wasn&#8217;t too difficult.\u00a0 While the number of homes were steadily growing (Teaneck had 4,192 residents at the turn of the 1920s and 16,513 by the end of the decade), there was still considerable open space.<\/div>\n<div dir=\"auto\">That started to change in the 1930s as more people started to move.\u00a0 The of the opening of GW Bridge &amp; Rt. 4, coupled with the sale of the Phelps estate after Mrs. Phelps death, led to a large influx in the number of homes available here.<\/div>\n<div dir=\"auto\">This is from the meeting of April 6, 1937:<\/div>\n<div dir=\"auto\"><a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2021\/04\/1937-04-06_Ordinance-on-chickens.jpg\" dir=\"auto\">Back then, we had very simple zoning.\u00a0 They had 3 types of zones A (residential), B (apartments), and C (commercial).<\/div>\n<div dir=\"auto\">The proposal was to ban chicken coops in Class A (residential) locations.<\/div>\n<div dir=\"auto\">As it turns out, Council wasn&#8217;t sure it was legal to only do it in Class A locations.\u00a0 Can something be unhealthy in one place, but healthy in another?<\/div>\n<div dir=\"auto\"><a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2021\/04\/1937-04-06_Health-Code-Ordinance-on-chickens.jpg\" \/><\/a><\/div>\n<div dir=\"auto\">Therefore, chicken coops would be banned <strong>anywhere<\/strong> in the Township:<\/div>\n<div dir=\"auto\"><a dir=\"auto\">A movement is born<\/h3>\n<div dir=\"auto\">With the ban on chickens, came the movement to remove the ban.<\/div>\n<div dir=\"auto\">The first attempt I&#8217;ve seen was on April 20th, 1943:<\/div>\n<div dir=\"auto\">\n<div dir=\"auto\"><a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2021\/04\/1943-04-20_Remove-Chicken-Ban.jpg\" data-rel=\"lightbox-image-5\" dir=\"auto\">There have been many tries to remove the chicken ban over the years.<\/div>\n<div dir=\"auto\">Prior to the current push, the last one was in 2013-14, when residents appeared before the council and requested the removal of the 1937 ban:<\/div>\n<div dir=\"auto\"><a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2021\/04\/2013-04-23_Council-considers-chickens.png\" data-rel=\"lightbox-image-6\" data-rl_title=\"\" data-rl_caption=\"\" title=\"\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-5644\" dir=\"auto\">At first not much came of it, but residents were persistent.<\/div>\n<div dir=\"auto\">Several months later, the health department and building department were asked to weigh in.<\/div>\n<div dir=\"auto\"><a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2021\/04\/2014-01-09_Chicken-Ban.jpg\" data-rel=\"lightbox-image-7\" data-rl_title=\"\" Katter, the health officer did, in fact, research the issue.<\/div>\n<div dir=\"auto\">At the time, I was a resident.\u00a0 But I&#8217;ve always been an opinionated one.\u00a0 Here was my opinion Health department listed many solid reasons (vermin, large animals etc) plus I&#8217;m the one who is going to get complaints from the upset neighbors. And rightfully so. I heard Sussex county has some great farms for sale&#8230; Go for it&#8230; you can move, stay and suck it up or simply run for office and push your rural agenda through.&#8221;<\/p><\/blockquote>\n<p>Clearly, challenging me has repercussions, but that&#8217;s for another thread.<\/p>\n<p>What did the Health Department say?<\/p>\n<blockquote><p>These ordinances (6-5) and (6-6) were originally adopted in 1951. Back then, Teaneck was far more farm, less developed and less suburban than today. The animals listed in the prohibition of keeping and ownership include farm animals (pigs, cows, horses, etc.), including fowl (ie: chickens, ducks, etc.). These animals, if allowed, will change the quality of life in Teaneck. These animals create unnecessary noise, attract vermin, create odors, all of which will generate numerous complaints. The keeping of poultry may also increase a presence of more dangerous predators like coyote and fox. The more wild animals drawn to the area create a public health risk of zoonotic diseases like rabies and tick borne diseases and can result in more potential car accidents and\/or road kill. Over the years, we have had people requesting to allow such animals as pigs, chickens and bees for all good purposes such as pets,food, pollination of home gardens, etc. I do understand these desires for personal purposes, economics and being a naturalist.<\/p>\n<p>As the health officer, I do have the responsibility to protect the public health and quality of life as I see appropriate. The 3 health officers that preceded me also felt that same way and this ordinance has been in effect ever since. I see no reason to amend the ordinance.<\/p>\n<p>&#8211; Ken Katter, Health Officer, CPM<br \/>\n(obtained via OPRA)<\/p><\/blockquote>\n<p>What did the Building Department say?<\/p>\n<blockquote><p>I have reviewed the Teaneck Town Code as it relates to this resident&#8217;s request to raise chickens on private property and offer the following comments:<\/p><\/blockquote>\n<ol>\n<li>\n<blockquote><p>Chapter 33, Development Regulations, does not have the keeping or raising of chickens as either a conditional use or accessory use to any of the permitted uses in any of the zone districts. Any request to raise chickens would, at the minimum, require the Zoning Board of Adjustment to interpret the zoning ordinance and determine whether the raising of chickens falls within the definition of accessory use (A subordinate use or building, the purpose of which is incidental to that of a main use or building on the same lot). The burden of proof at this hearing would be on the applicant to show that the raising of chickens would not undermine the goals and objectives of the Teaneck Master Plan including to preserve the character of existing low-density residential neighborhoods. If the Zoning Board of Adjustment determines that the raising of chickens is not an accessory use in a zone district, a variance must be obtained and the applicant would need to prove that the benefit of approving such variance outweighs the negative impact of the use.<\/p><\/blockquote>\n<\/li>\n<li>\n<blockquote><p>The selling of chickens or eggs would be considered a business and, if conducted on a residential property, would be a prohibited use. The ability to sell chickens or eggs would require an applicant to obtain a variance from the Zoning Board of Adjustment to conduct a business from the residential property.<\/p><\/blockquote>\n<\/li>\n<li>\n<blockquote><p>Structures used to house chickens would be considered accessory structures and need to complywith the current bulk requirements.<\/p><\/blockquote>\n<\/li>\n<\/ol>\n<blockquote><p>The Township of Teaneck developed from its rural roots into a suburban community and continues to experience the trend towards a more dense physical environment. The smaller size of the average residential lot may not provide the ability of the property owner to buffer this type use (raising of chickens) from adjacent properties, rendering the use inappropriate for most neighborhoods. If this request will be considered further, I recommend that the Township Planner provide input to assure that any modification of the regulations does not negatively impact the Master Plan document.<\/p><\/blockquote>\n<p>I&#8217;m still of the opinion that this can be done well, as it&#8217;s been done in other locations.\u00a0 Neighbor concerns are valid, but capable of being addressed via appropriate zoning\/legislation and permitting.<\/p>\n<p>Having heard from those in favor, the current council majority has indicated that they may be willing to change the ban, effectively signaling the ending of 84 years of poultry prohibition.\u00a0 Other towns have done so and they seem to have had very few issues, so I believe it&#8217;s possible.<\/p>\n<p><strong>But, history has shown that when people start to come out against, those maybe&#8217;s sway back to no&#8217;s.<\/strong><\/p>\n<p><span style=\"text-decoration: underline;\">So&#8230;. don&#8217;t count your chickens before they&#8217;re hatched.<\/span><\/p>\n<p>To be continued.<\/p>\n<hr \/>\n<p>Notes:<\/p>\n<ol>\n<li>It&#8217;s unclear if this ordinance was in any way related to the incident that took place in 1932.\u00a0 It&#8217;s recounted during the August 23, 1932, Council discussion on Ordinance #639 &#8220;AN ORDINANCE TO PRE&amp;ERVE AND MAINTAIN PEACE AND ORDER AT ALL MEETINGS, GATHERINGS AND ASSEMBLIES THROUGHOUT THE TOWNSHIP OF TEANECK.<br \/>\nThere was a lively debate over the issue, which inevitably led to the failure of passage.\u00a0 But during the back and forth, Mr. Walker posed a question to Mr. Morton.<\/p>\n<blockquote><p>Mr. Walker asked Mr. Morten, through the Chairman, whether any previous meeting would have come under this ordinance?
