{"id":702,"date":"2018-12-10T20:37:46","date_gmt":"2018-12-10T20:37:46","guid":{"rendered":"https:\/\/www.teanecktoday.com\/blog\/?p=702"},"modified":"2018-12-16T04:31:15","modified_gmt":"2018-12-16T04:31:15","slug":"why-re-codification-of-the-teaneck-code-is-important","status":"publish","type":"post","link":"https:\/\/www.teanecktoday.com\/blog\/lawsuits\/why-re-codification-of-the-teaneck-code-is-important\/","title":{"rendered":"Why re-codification of the Teaneck Code is important"},"content":{"rendered":"<p>At some point in the past, the township passed a rule to prohibit businesses from operating on the first floor of buildings.&nbsp; Not only could they not operate, say, in a basement &#8212; but they had to be seen from the street.<\/p>\n<p>Maybe this provision made sense at some point in time.&nbsp; It has become pointless today.&nbsp; <\/p>\n<p>Whether or not it made sense when the provision was last tinkered with (in 1951) is debatable, but it appears that I&#8217;m not the first person to think this is pointless and counter-productive.&nbsp; Teaneck also considered it pointless in 1973.<\/p>\n<p>That&#8217;s the year that the Teaneck Council passed <a href=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/12\/Ordinance-1568-1.pdf\">ordinance 1568<\/a>, which reads in relevant part:<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><u>Section 3.<\/u>&nbsp;That Sec. 5-14 entitled &#8220;Buildings to be open to public view&#8221; and Sec. 5-15 entitled &#8220;Business to be conducted at street level; exception as to bowling alleys&#8221; of said Chapter 5 entitled &#8220;Amusements&#8221; <strong>be deleted in their entirety<\/strong>&#8220;. (emphasis added)<\/p><\/blockquote>\n\n\n\n<!--more-->\n\n\n<p>You may recall that section of our code, from a <a href=\"https:\/\/www.teanecktoday.com\/blog\/teaneck\/lawsuit-senator-weinberg-to-teaneck-business-not-in-my-backyard\/\">recently filed lawsuit<\/a> against the Township &#8212; by our Senate representative, Loretta Weinberg.<\/p>\n<p>Nearly the entire basis of the Senator&#8217;s lawsuit stems from enforcement of Section 5-14 of our code.&nbsp; A provision that was <strong>removed <\/strong>from the code, when the Township adopted Ordinance 1568 on August 7, 1973.<\/p>\n\n<h2 class=\"wp-block-heading\">How did this happen?<\/h2>\n\n\n<p>After an ordinance is passed, it goes through a process to amend the actual code.&nbsp; It appears as if the clerk at the time, properly submitted the ordinance.&nbsp; That submission did in fact update the definitions of Chapter 5, section 1 and it&nbsp;<a href=\"https:\/\/ecode360.com\/13649198\">removed Section 5-15<\/a>, which currently reads:&nbsp;<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><a href=\"https:\/\/ecode360.com\/13649197#13649198\">Sec.&nbsp;5-15 Repealed by Ordinance No. 1568, \u00a7&nbsp;3.<\/a><br><\/p><\/blockquote>\n\n\n<p>But, for some reason, section 5-14 was not removed.&nbsp; So it sat.&nbsp;&nbsp;<\/p>\n<p>A former member of council asked the question of me on Facebook:<\/p>\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"521\" height=\"65\" src=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/12\/2018-12-05_Sohn-FB-Comment.png\" alt=\"\" class=\"wp-image-712\" srcset=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/12\/2018-12-05_Sohn-FB-Comment.png 521w, https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/12\/2018-12-05_Sohn-FB-Comment-300x37.png 300w\" sizes=\"auto, (max-width: 521px) 100vw, 521px\" \/><\/figure>\n\n\n<p>Perhaps a prior council (like the one then Councilwoman Loretta Weinberg or this individual sat on) should have ensured that previous codifications were correct.&nbsp; But, alas, it appears that did not happen.<\/p>\n<p>Codes are important.&nbsp; They are the rules we go by and residents cannot be expected to live according to them, if they can&#8217;t even know what they are.&nbsp; Re-codification is an important and necessary process.&nbsp;<\/p>\n<p>So now, in 2018, a 45 year old mistake will be rectified.&nbsp; It should have been done sooner &#8212; and every council should have paid closer attention to this issue.&nbsp; <\/p>\n<p>Ironically, one of the many who never paid attention is the person that brought suit using a non-existent basis of law.<\/p>\n<p>Well, at least that won&#8217;t be an issue going forward.<\/p>\n\n<ul class=\"wp-block-gallery columns-1 is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\"><li class=\"blocks-gallery-item\"><figure><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"975\" src=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/12\/Weinberg-v-1568-1024x975.png\" alt=\"\" data-id=\"710\" data-link=\"https:\/\/www.teanecktoday.com\/blog\/?attachment_id=710\" class=\"wp-image-710\" srcset=\"https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/12\/Weinberg-v-1568-1024x975.png 1024w, https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/12\/Weinberg-v-1568-300x286.png 300w, https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/12\/Weinberg-v-1568-768x731.png 768w, https:\/\/www.teanecktoday.com\/blog\/wp-content\/uploads\/2018\/12\/Weinberg-v-1568.png 1066w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure><\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<p>At some point in the past, the township passed a rule to prohibit businesses from operating on the first floor of buildings.&nbsp; Not only could they not operate, say, in a basement &#8212; but they had to be seen from the street.
